This spring, \u00abThe 4th Company\u00bb will be released worldwide as a Netflix original film. Based on a true story, the film portrays the incessant violence and corruption experienced by the inmates of\u00a0Santa Martha Acatitla<\/em>, a Mexico prison, during the 1980s. A network of crime and corruption thrives inside this prison due to a complete lack of governance, and inmates’ human rights are constantly violated.<\/p>\n

Many things have changed in Mexican prisons since the 1980s, mostly as a result of better laws, increased transparency, and more prevalent data. However, despite improvement in many areas, the Mexican prison system still faces significant challenges. This was confirmed by the\u00a0WJP Rule of Law Index<\/em><\/a> 2017-2018 which considered prisons to be the single most vulnerable component of the Mexican criminal justice system.<\/p>\n

An effective criminal justice system is a key aspect of the rule of law, as it constitutes the conventional mechanism to redress grievances and bring action against individuals for offenses against society. For this reason, an effective criminal justice system is one of the eight factors included in the WJP Rule of Law Index, which measures adherence to the rule of law in more than 100 countries.<\/p>\n

A complete assessment of the delivery of criminal justice must consider the system in its entirety, examining criminal investigations, the criminal adjudication system, if the system is impartial, free of corruption and free of improper government influence, due process of law, and incarceration. In the WJP Index, an effective correctional system is considered to be one in which the rights of inmates are respected, conditions of safety and security are guaranteed, and programming which prepares inmates for social reintegration is provided.<\/p>\n

In short, a strong rule of law needs an effective criminal justice system, and an effective criminal justice system needs prisons that are secure, respectful of the rights of inmates, and effective in combating recidivism.<\/em><\/h4>\n

Las c\u00e1rceles son un componente fundamental del Estado de Derecho<\/strong><\/em><\/p>\n

Esta primavera se estrenar\u00e1 la pel\u00edcula \u201cLa 4ta Compa\u00f1\u00eda\u201d a nivel mundial como original de Netflix. Basada en una historia real, la cinta refleja experiencias de violencia y corrupci\u00f3n en la Penitenciar\u00eda de Santa Martha Acatitla, en la Ciudad de M\u00e9xico, durante la d\u00e9cada de 1980. Describe condiciones de ingobernabilidad, violaci\u00f3n constante a los derechos humanos de las personas privadas de la libertad, as\u00ed como redes de delincuencia y corrupci\u00f3n.<\/p>\n

Muchas cosas han cambiado en las c\u00e1rceles mexicanas desde la d\u00e9cada de 1980, principalmente como resultado de leyes m\u00e1s garantistas, mayor transparencia y mejores datos. A pesar de estos cambios, el sistema penitenciario mexicano todav\u00eda enfrenta grandes desaf\u00edos, como se confirma en el \u00cdndice de Estado de Derecho 2017-2018 del WJP, que eval\u00faa a las c\u00e1rceles como el componente m\u00e1s vulnerable del sistema de justicia penal mexicano.<\/p>\n

Un sistema de justicia penal efectivo es un aspecto clave del Estado de Derecho, ya que constituye el mecanismo formal para reparar agravios y resolver delitos. Por esta raz\u00f3n, un sistema de justicia penal efectivo es uno de los ocho factores incluidos en el \u00cdndice de Estado de Derecho del WJP, el cual mide el respeto al Estado de Derecho en m\u00e1s de 100 pa\u00edses.<\/p>\n

Una evaluaci\u00f3n completa de la justicia penal debe considerar al sistema en su totalidad, incluyendo las investigaciones, el sistema de impartici\u00f3n de justicia, si el sistema es imparcial, libre de corrupci\u00f3n y libre de influencias indebidas, el debido proceso legal, y la calidad de las c\u00e1rceles. En el \u00cdndice del WJP, se considera que un sistema penitenciario efectivo es uno en el que se respetan los derechos de las personas privadas de la libertad, se garantizan condiciones de seguridad, y se proporcionan programas que favorecen la reinserci\u00f3n social.<\/p>\n

En resumen, un Estado de Derecho s\u00f3lido necesita un sistema de justicia penal efectivo, y un sistema de justicia penal efectivo necesita c\u00e1rceles seguras, respetuosas de los derechos de las personas privadas de la libertad, y deben ser efectivas en reducir la reincidencia.<\/p>\n
