{"id":621,"date":"2018-06-15T12:31:15","date_gmt":"2018-06-15T17:31:15","guid":{"rendered":"https:\/\/worldjusticeproject.mx\/?p=621"},"modified":"2022-10-11T12:01:06","modified_gmt":"2022-10-11T17:01:06","slug":"la-nueva-justicia-penal-en-mexico","status":"publish","type":"post","link":"https:\/\/worldjusticeproject.mx\/en\/la-nueva-justicia-penal-en-mexico\/","title":{"rendered":"La Nueva Justicia Penal en M\u00e9xico"},"content":{"rendered":"<p><strong>Resultados de la reforma de justicia penal en M\u00e9xico, a dos a\u00f1os de su implementaci\u00f3n<\/strong><\/p>\n<p>Han pasado 10 a\u00f1os desde que, en 2008, M\u00e9xico aprob\u00f3 una reforma constitucional con el objetivo de transformar dr\u00e1sticamente la justicia penal. Con el sistema acusatorio adversarial se buscaba garantizar procesos transparentes, eficientes, y respetuosos de los derechos de las v\u00edctimas y de las personas acusadas por alg\u00fan delito. El plazo de ocho a\u00f1os que se estableci\u00f3 en la Constituci\u00f3n para que las 32 entidades del pa\u00eds transitaran al Nuevo Sistema de Justicia Penal (NSJP) concluy\u00f3 en junio de 2016, hace dos a\u00f1os. En este punto del camino recorrido, <em>\u00bfcu\u00e1l ha sido el impacto de la reforma penal?<\/em><\/p>\n<p>Para contestar esta pregunta, el World Justice Project (WJP) y Abogados con C\u00e1mara, A.C. realizaron un an\u00e1lisis de la Encuesta Nacional de Poblaci\u00f3n Privada de la Libertad (ENPOL) \u2013que incluye respuestas de m\u00e1s de 58 mil personas privadas de la libertad\u2013, en combinaci\u00f3n con una base de datos de la fecha de implementaci\u00f3n de la reforma a nivel municipal y por tipo de delito, y hoy presentan el reporte <strong>\u201cLa nueva justicia penal en M\u00e9xico: Avances palpables y retos persistentes\u201d<\/strong>.<\/p>\n<p>El reporte explica que, como resultado de la implementaci\u00f3n del NSJP, las sentencias son m\u00e1s claras, los jueces est\u00e1n presentes y ponen atenci\u00f3n en las audiencias, y las audiencias son grabadas en audio y\/o video. Adem\u00e1s, los procesos judiciales son m\u00e1s r\u00e1pidos.<\/p>\n<p>Tambi\u00e9n se encontr\u00f3 que los efectos positivos de la reforma toman tiempo. De hecho, los primeros implementadores del nuevo sistema muestran un mejor desempe\u00f1o que las otras entidades del pa\u00eds, aunque en todas se observan mejoras graduales.<\/p>\n<p>Por otro lado, el an\u00e1lisis revela que persisten retos en la polic\u00eda y las fiscal\u00edas, y hoy, el maltrato a las personas durante la detenci\u00f3n sigue siendo un problema frecuente.
